HR Software for Small Business: Hiring Compliance Features Compared
Updated 10 min read
For owners and office managers of small U.S. employers choosing HR software. We left payroll, benefits and price aside and read 7 small-business HR and payroll tools on October 22, 2026 for one thing: how much of the hiring file each one keeps. That means the Form I-9, E-Verify, the background check and its FCRA forms, the state new-hire report and the record that proves it all. Verdicts are by use case. Head-to-head questions on two big names are answered in Rippling vs Gusto.
I-9, E-Verify and the FCRA forms in one platform; checks by a PBSA-accredited firm.
Files the state new-hire report and audits each personnel file for gaps.
Self-onboarding I-9, new-hire reporting and checks inside the scheduling app.

The hiring file a small employer keeps
The hiring file is the set of papers a federal or state agency, or a rejected applicant's lawyer, can ask to see, and most of them run on a date. The FCRA has no headcount floor, so a one-person business that orders a background check owes the same steps as a large one. Each step below is a column in the roster.
| Step | Roster column | When | Cite |
|---|---|---|---|
| Background-check disclosure and permission | FCRA disclosure and consent forms | Before the report is ordered | 15 U.S.C. § 1681b(b)(2)(A) |
| Form I-9 Section 1 (employee) | Form I-9 | By the first day of work | 8 CFR 274a.2(b)(1)(i)(A) |
| Form I-9 Section 2 (employer) | Form I-9 | Within 3 business days after day one | 8 CFR 274a.2(b)(1)(ii) |
| E-Verify case (enrolled employers) | E-Verify cases | By the 3rd business day after work for pay starts | E-Verify User Manual § 1.5 |
| Report the hire to the state | State new-hire report | Within 20 days, sooner where the state says | 42 U.S.C. § 653a(b)(2) |
| Reverify on Supplement B | Work-permit expiry reminders | By the date work authorization expires | 8 CFR 274a.2(b)(1)(vii) |
| Keep the Form I-9 | Stored records and audit trail | 3 years after hire or 1 year after the job ends, whichever is later | 8 CFR 274a.2(b)(2)(i)(A) |
The disclosure must be clear and conspicuous, in writing, “in a document that consists solely of the disclosure”, and the applicant must give written permission, which may sit on that same page. An HR tool that tucks the disclosure into its application form or offer packet does not meet that. Test your wording in the FCRA disclosure checker.
15 U.S.C. § 1681b(b)(2)(A)
Start Monday, finish Section 2 by Thursday; day one does not count. Software can put the due date on a dashboard, but the person who examines the documents still signs Section 2. The I-9 and E-Verify deadline calculator counts the business days for any start date.
Keeping the I-9 inside HR software is allowed, but only in a system that guards the forms against unauthorized changes, logs who opened or changed each one and when, documents how the records are kept, and captures e-signatures that confirm the signer read the attestation (8 CFR 274a.2(e) to (i)). That is why the records column asks for an audit trail and not just storage.
The roster
7 tools, as their own pages describe them. A word in a cell is what the vendor publishes; “Not published” means the pages we read say nothing, and “Check with the vendor” means they say something close but not enough to rely on. “Via partner” names the firm that does the work. On a wide screen the roster scrolls sideways inside its frame; on a phone each tool gets its own card.

Who runs each step
The roster has 7 hiring steps. Folded into three counts, it shows how much of the file each tool takes off your desk, how much it hands to a partner firm, and how much stays with you. A step run through a partner is still a step: you sign the partner's terms, and its forms are the ones the applicant sees.
| Tool | Runs itself | Through a partner | Left to you or unclear |
|---|---|---|---|
| isolved | 4 | 1 | 2 |
| OnPay | 3 | 1 | 3 |
| Homebase | 4 | 0 | 3 |
| Eddy | 2 | 1 | 4 |
| Namely | 2 | 1 | 4 |
| BambooHR | 1 | 3 | 3 |
| Square Payroll | 1 | 0 | 6 |
Two patterns stand out. The payroll-first tools are strongest on the state new-hire report, because they already hold the hire date and the address, and weakest on E-Verify. The HR platforms carry the I-9 and the audit trail but leave the background check to a partner. None of the tools says on its own pages that it reminds you when an employee's work permit runs out; the I-9 reverification calculator covers that gap, and Green Cards and U.S. passports never need reverifying.
Rippling and Gusto, the two names on almost every roundup, are read head to head in Rippling vs Gusto for hiring compliance. Tools built around onboarding rather than payroll, such as WorkBright and HR Cloud, are in the onboarding software compare.
What to do
- Circle the steps your current payroll tool leaves to you; that list is what you are shopping for.
- If the background check runs through a partner, check the partner on the PBSA-accredited screener roster before you sign.
- Run the hiring compliance checklist against the demo, step by step.
The tools, one by one
isolved
An HR and payroll platform with a page written for small companies. Its onboarding has built-in I-9 processing and e-signatures, its E-Verify tool submits cases from the same platform, and its background checks are run by ProScreening with the FCRA forms inside the order flow.
Employers who want the I-9, E-Verify and the background-check paperwork in one system and are ready for a fuller platform than a payroll app.

Questions to ask in the demo
A sales page says “compliant onboarding”. A demo can show you whether it is. Book thirty minutes and ask the vendor to do these on screen with a test hire, not to describe them.
Ask the vendor to show you
- One finished Form I-9 and its audit log: who opened it, when, and what changed.
- Where Section 2 is signed, who signs it, and the due date the dashboard sets for a Monday start.
- Whether E-Verify cases open from the finished I-9 without retyping, and whether the vendor runs cases itself as an E-Verify employer agent or you enroll and run them.
- The background-check disclosure the applicant will see, on its own page with nothing else on it. Then the pre-adverse notice: does it attach a copy of the report and the Summary of Rights?
- Whether it files your state's new-hire report, or only stores the data for you to file.
- The date it would let you destroy a former employee's I-9, and how it calculates it.
E-Verify itself is free. A vendor or employer agent may charge for running it for you, which is a service, not a fee to the government. Cases run only after the hire and the I-9, never to screen applicants. The E-Verify guide for employers covers enrollment and the Memorandum of Understanding.
E-Verify User Manual § 1.1
If the background check runs through the HR tool, the notices are still yours to send. The pre-adverse and adverse action notice guide sets out the two letters and what goes in each.
How we compared
We read each vendor's own public pages and the lists named below on . A word in the table is what the vendor publishes. Where a vendor does not publish a feature, the table says “Check with the vendor” or “Not published”: ask them before you rely on it. Verdicts are by use case, never by price.
We chose HR and payroll tools sold to small U.S. employers whose own pages describe at least one hiring step, then read their product, help and partner pages. The 7 columns are the steps of the hiring file under the FCRA, the Form I-9 rules, E-Verify and state new-hire reporting; payroll, benefits and price were not scored. Screening partners were checked against PBSA's Accredited Firms Directory the same day. Justworks, Paychex, ADP and Patriot Software answered our reader with a bot check, and GoCo was moving into Intuit on the read date, so they are left out rather than guessed at.
Verdicts are editorial: no vendor can buy a verdict position or displace another vendor.

Questions employers ask
What is the best HR software for a small business?
For the hiring file, it depends on which steps you want handled. On their own pages, isolved carries the I-9, E-Verify and the FCRA forms in one platform; OnPay files the state new-hire report and audits each personnel file; Homebase puts the I-9 and background checks inside the scheduling app hourly teams already use. If you only need payroll, keep it, and add the I-9 steps from the new-hire checklist.
Do I need HR software to stay compliant when hiring?
No. The law sets the steps, not the tool: a paper Form I-9 kept on file is still legal, and you never file it with USCIS. Software helps with the dates and the record. If you keep I-9s electronically, the system has to meet 8 CFR 274a.2(e) to (i): controls against changes, a log of every access, and e-signatures that confirm the attestation was read.
Does a five-person business have to follow the FCRA?
Yes, if it orders background reports. The FCRA's hiring steps bind any “person” that orders a report for employment purposes, with no employee-count floor. The FCRA rules for employers walk through each step, and the background check compare for small business reads the screening firms themselves.
Can I check I-9 documents over video with these tools?
Only if you are enrolled in E-Verify and in good standing, at your E-Verify hiring sites, using the DHS alternative procedure: copies first, then a live video call, then the box on the form. A tool that offers remote review does not change who may use it. See remote I-9 and the DHS alternative procedure.
Is specialist I-9 software better than the I-9 inside an HR suite?
It is built around the I-9 alone, and the tools in that compare are read on reverification reminders, purge dates and remote review. An HR suite wins on having one record for the hire. If you hire people on work permits or you have been through an inspection, read the I-9 and E-Verify software compare before you choose.
